Terms of Service

Beta Service Notice: Orbiter Dev is currently in beta. These terms govern your use of a pre-release service that is under active development and may change significantly before general availability.

1. Description of Service

Orbiter Dev (“the Service”) is a mobile companion tool for developers using AI coding assistants. It enables users to receive notifications about, review, and respond to actions proposed by AI coding agents. The Service is currently offered as a beta program and is provided for evaluation purposes.

2. Beta Program

• Pre-Release Software: The Service is in active development. Features may be incomplete, contain errors, or be changed, suspended, or removed at any time without notice.
• No Uptime Guarantee: We do not guarantee any level of availability, reliability, or performance during the beta period.
• Service Changes: We reserve the right to modify, suspend, or discontinue any aspect of the Service at our sole discretion, without prior notice or liability.
• Beta Access: Access to the beta is provided on an invitation basis and may be revoked at any time.

3. Your Responsibilities

You are responsible for your code.

Orbiter Dev helps you review actions proposed by AI coding agents, but it does not generate, modify, or execute code. We make no representations about the quality, safety, or correctness of any code or actions you choose to approve.

• No Warranty on Code: We do not warrant that code or actions reviewed via Orbiter Dev are free of bugs, vulnerabilities, or errors.
• Your Decisions: You assume full responsibility for any consequences resulting from actions you approve, reject, or take based on information provided through the Service.

4. Acceptable Use

You agree NOT to:

• Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of any part of the Service.
• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Interfere with or disrupt the integrity or performance of the Service.
• Attempt to gain unauthorised access to any part of the Service or its related systems.
• Use the Service to transmit spam, malware, or any harmful content.
• Share your beta access credentials with any third party.

5. Intellectual Property

• Your Content: You retain all rights to any code, data, or content that you process through the Service. We claim no ownership over your content.
• Our IP: The Service, including its design, features, branding, and underlying technology, is the exclusive property of the Orbiter Dev team and is protected by applicable intellectual property laws.
• Feedback: Any feedback, suggestions, or ideas you provide regarding the Service may be used by us without restriction or obligation to you.

6. Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE ORBITER DEV TEAM BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
• ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES;
• ANY DAMAGE ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE;
• ANY DAMAGE ARISING FROM UNAUTHORISED ACCESS TO OR ALTERATION OF YOUR DATA;
• ANY MATTERS BEYOND OUR REASONABLE CONTROL.

OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED €100 (ONE HUNDRED EUROS).

7. Indemnification

You agree to indemnify and hold harmless the Orbiter Dev team from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

8. Termination

• We may suspend or terminate your access to the Service at any time, for any reason, without notice or liability.
• You may stop using the Service at any time.
• Upon termination, your right to use the Service ceases immediately.

9. Modifications to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to this page, with the “Last Updated” date revised accordingly. Your continued use of the Service after any changes constitutes acceptance of the revised Terms. We will make reasonable efforts to notify active beta users of material changes via email or in-app notification.

10. General

• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
• Entire Agreement: These Terms constitute the entire agreement between you and us regarding your use of the Service during the beta period.
• No Waiver: Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision.
• Assignment: We may assign our rights and obligations under these Terms without your consent. You may not assign your rights without our prior written consent.
